Booking Terms and Conditions

YOUR QUOTE

Your quote is based upon the information you have provided, taking into consideration: vehicle & chauffeur availability, time of day, time of year, journey time, journey distance, parking charges, road tolls, chauffeur accommodation costs, the number of passengers and the amount of luggage. If your requirements change, please ask for a revised quote.

CONFIRMING YOUR BOOKING

A deposit is required when making a booking. Once the deposit has been received, we will send you a booking confirmation by email with the details of your journey. A quote does not guarantee our availability, and we are unable to hold any dates until a deposit has been paid.

PAYMENT OPTIONS

Full payment for your transfer is due before or on completion of your journey. Payments can be made by bank transfer, payment link or by bank card in the vehicle.

YOUR JOURNEY

Your chauffeur will collect you from the agreed pick-up location at the designated time, transport you and your luggage to the designated drop-off point and make reasonable comfort stops en route. It is your responsibility to check that the pick-up time is suitable for your schedule. We are not liable for delays caused by unforeseen traffic conditions, road closures, accidents, or any other factors beyond our control, including but not limited to weather disruptions or roadworks.

The Customer is responsible for ensuring that they have an appropriate level of travel insurance to cover personal belongings, damage to luggage and any consequential or indirect losses that may arise, including delays, missed flights and trip interruption.

For airport drop-offs, we recommend aiming to arrive at the airport at least 3 hours before your flight gate closes.

CANCELLING A BOOKING

Cancellations made at least 7 days before the scheduled transfer will be fully refunded. Cancellations made less than 7 days before the scheduled transfer will be subject to a charge of £100. Cancellations made less than 24 hours before the scheduled transfer will incur the full fare. Please get in touch with us as early as possible if you need to cancel your booking.


NO SHOWS

If you fail to show up for a booked transfer and make no contact with Cornwall Transfers or your designated driver to cancel your booking (see above), you agree to pay the full fare and reimburse any reasonable additional costs incurred by us.

DELAYED FLIGHTS

On airport pick-ups, we will track your flight and aim to minimise disruption to your onward journey caused by flight delays. However, please understand that for long-distance journeys, the driver may need to set off before your flight has taken off. We are not able to guarantee driver availability for flights delayed by more than 6 hours, and such situations would be treated as a chargeable “no show”. In such (rare and insurable) situations will assist you in booking an alternative transfer to your final destination.

WAITING TIME

For airport pick-ups we allow 1 hour from the time the flight actually lands to meet with your driver. After this, waiting time is charged, at £30/hr pro rata. Waiting time for all other journeys will be charged at £30/hr pro rata, either from the scheduled collection time or for any unscheduled stops en-route.

PASSENGER CONDUCT

We reserve the right to refuse to transport or cease to transport any Passenger who behaves in a disorderly, threatening or abusive manner or who, in our absolute discretion, we consider a nuisance or a danger to our employees, agents, subcontractors or to fellow Passengers and may require such a Passenger to alight from a Passenger Vehicle and the Customer may be charged a Cancellation Fee. We are committed to providing Services in accordance with the Equality Act.

VEHICLE ALLOCATION

The vehicle type and/or capacity will be confirmed on the booking confirmation. If the allocated vehicle size is unexpectedly unavailable we will provide a larger vehicle at no additional cost.

DRIVER-PARTNERS & THIRD-PARTY OPERATORS

We use our own transport and drivers wherever possible, but do occasionally act as agents for carefully selected, fully licenced and vetted driver-partners and third-party operators when unable to fulfil bookings ourselves. Your booking confirmation will clearly state where this is the case.

CAPACITY OF THE OPERATOR

1.1. Service Provision: Nicholas Smith T/A Cornwall Transfers & Tours (the “Company”) operates in two capacities depending on the fulfilment of the booking.

1.2. Principal Status: Where Bookings are fulfilled using a company-owned and operated licensed vehicle, the Company acts as the Principal provider of the transportation service. The contract for carriage is then directly between the Passenger and Cornwall Transfers and Tours (Nicholas Smith).

1.3. Agent Status: Where a booking is fulfilled by a Third-Party Operator or an independent, self-employed Driver-Partner, the Company acts solely as a Disclosed Booking Agent. In these instances, the contract for the transportation service is formed directly between the Passenger and the designated Driver-Partner or Third-Party Operator (the “Principal”).

1.3.1. Collection of Fares: Where the Company acts as a Booking Agent, it is authorised by the Principal (the Driver or Third-Party Operator) to accept and reach an agreement on the fare, and to collect all payments made by the Passenger for and on behalf of that Principal.

1.3.2. Settlement: Any payment made by the Passenger to the Company shall be acknowledged as a payment made directly to the Principal, discharging the Passenger’s liability to the Principal for the cost of the journey. The Company will subsequently remit the fare to the Principal, less any agreed booking fees or commissions.

PRIVACY AND DATA SHARING

1.1. Role of the Company: Nicholas Smith T/A Cornwall Transfers & Tours is the Data Controller of your personal information provided at the time of booking.

1.2. Lawful Basis: We process your data (name, phone number, pickup/drop-off addresses) under the lawful basis of Contractual Necessity to fulfil your booking request.

1.3. Sharing with Service Providers: Where the Company acts as a Booking Agent, your details will be shared with the assigned Driver-Partner or Third-party Operator. In these instances, the assigned party acts as an Independent Data Controller and is responsible for handling your data securely in accordance with UK GDPR.

1.4. Mandatory Records: We are legally required by our Private Hire Operator Licence to maintain records of all bookings (including passenger names and journey details) for a minimum period of 12 months, which may be inspected by the Licensing Authority or Police upon request.

If you are unhappy with any aspect of our service, we welcome the opportunity to put it right! Please contact us at hello@cornwalltransfers.co.uk with details of your complaint and we’ll aim to sort it straight away. If we fail to deliver on the expected service as set out in these terms and conditions, we’ll refund your fare.

Refunds are limited to the amount of any fare paid directly to Cornwall Transfers and Tours for the single journey on which our service was agreed to be below standard. This guarantee does not affect your statutory rights.
